Interpretation

The “Seller” Infracam (Infrared Camera Warehouse Ltd) Company Number 09154092 registered in England hereafter referred to as INFRACAM.

“Buyer” means the person, firm or company who accepts Infracam’s quotation for the sale of goods, consultancy services or whose order for the goods is accepted by Infracam.

“Consumer” means any human or corporate body that is acting for purposes which are outside his business, trade or profession.

“Contract” means the contract for the sale and purchase of the goods.

“Goods” means the goods (including any installment of the goods or any parts for them) that Infracam is to supply in accordance with these terms.

“Terms” means the standard terms of sale set out in this document and (unless the context otherwise requires) includes any special terms agreed between the Buyer and Infracam.

“Working day” means Monday to Friday excluding Bank and Public Holidays and the period between Christmas Day and New Year’s Day.

“Writing” and any similar expression includes fax, email or in writing.

Basis of the sale

Infracam shall sell and the Buyer shall purchase the Goods in accordance with these Terms, which shall govern the contract to the exclusion of any other terms save those specifically in Writing by both parties. No variation to these Terms whether verbal or written on such documents as a purchase order shall be binding unless specifically agreed in Writing by Infracam. No representations concerning the Goods are binding unless confirmed in Writing by Infracam but nothing in these Terms affects the liability of either party for fraudulent misrepresentation. Any advice or recommendation given by Infracam as to storage, application or use of the Goods which is not confirmed in Writing by Infracam is followed or acted on entirely at the Buyer’s own risk and Infracam shall not be liable for any such advice or recommendation which is not so confirmed. Any typographical, clerical or other error or omission in any sales literature, website, quotation, invoice or other document or information issued by Infracam shall be subject to correction without any liability on the part of Infracam. Where specific makes are mentioned in connection with replacement parts it is not implied that Infracam has any association with the original maker. No part of any Infracam publication may be reproduced, stored or transmitted in any form or by any means without the written approval of Infracam. It is acknowledged that all trademarks and trade names mentioned in any Infracam publication or on the Infracam websites other than those owned by Infracam are the property of their respective companies/owners.

Orders

A contract between us will not be formed until your payment has been accepted by us and we have debited your credit or debit card. This will form the terms of your acceptance of the contract. Once your payment has been accepted, you will receive a confirmation email from Infracam stating that the order has been successful and it is now being processed (some customers may occasionally find this in their Junk mailbox).

At this time, Infracam uses the ‘Capture’ setup within PayPal as its main payment method. Meaning that once the Buyer has placed an order, the funds are immediately charged to their payment method and transferred to us. Upon payment being received on PayPal, Infracam shall immediately go about delivering the order to the Buyer in accordance with our Delivery Policy.

No order submitted by the Buyer shall be deemed to be accepted by Infracam unless and until confirmed by Infracam which confirmation will set out the quantity, quality and description of the Goods and any special terms relating to the Contract. The Buyer shall be responsible to Infracam for ensuring the accuracy of any order submitted.

Price of goods

The price of Goods will be Infracam’s quoted price or failing which, the price listed on the Infracam website at the date of acceptance of the order. Infracam reserves the right to vary its advertised prices at any time.

Prices are correct on the Infracam website. We reserve the right to update these prices at our discretion. We are not obliged to accept your order for such goods and may decline it or limit the order quantity.

Occasionally, an error may occur and goods may be incorrectly priced in which circumstances, we will not be obliged to supply the goods at the incorrect price.

Consultancy

Through our parent company, ID Dynamics, Infracam also offers bespoke design and consulting services for private residences and industrial sites. Separate terms will apply to these contracts. Please contact us for more information.

Availability

While Infracam endeavor to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you we will contact you immediately and refund the price paid for such goods as soon as possible. We may, in our absolute discretion, as soon as possible raise a credit to offset the amount invoiced to you.

Licensing & export controls

Please note that export of any night vision system, be it image intensified, thermal or other, above a given specification (normally 8Hz for thermal) is strictly controlled by ITAR (International Traffic in Arms) regulations.

All of these systems are subject to UK Government Export Licensing Regulation and dependent on specification. A license may need to be obtained prior to the export, even temporarily (eg; holiday), from the U.K. Generally, these products may not be sold, transferred or exported to current areas of conflict or prohibited countries like Iran, Iraq, Syria, Yemen, North Korea, Somalia and Sudan.

It is the responsibility of the exporter, whether it be a company or individual, to ensure that such a license is obtained. FAILURE TO COMPLY IS A CRIMINAL OFFENSE.

INFRACAM RESERVES THE RIGHT, AT ITS COMPLETE DISCRETION, TO WITHHOLD SALES OF THERMAL CAMERAS IF IT SUSPECTS OR OBTAINS EVIDENCE THAT SUCH A LICENSE IS BEING DELIBERATELY AVOIDED OR THE PRODUCTS ARE ULTIMATELY DESTINED TO A RESTRICTED AREA.

Warranties

Different products carry different manufacturer’s warranties. Please refer to the warranty card enclosed with the product for details of the specific warranty. All warranties are limited to the original purchaser and cover manufacturing defects in workmanship or materials only. Normal wear and tear, excessive abuse are not covered nor is damage resulting from, but not limited to, abuse, neglect, accident, improper or inadequate maintenance, battery leakage, use with non approved accessories or altering from the original state. Some parts are not covered by warranty. At sole Infracam’s discretion, we will replace the product if it is determined by us to be defective. There are no implied warranties of merchantability or fitness for a particular purpose. Infracam shall not be liable to incidental, consequential or special damages arising out of or in connection with product use or performance.
